Terms of Service

These Terms of Service (“Terms”) govern your access to and use of apower-hvac.com (the “Site”) operated by A-Power HVAC-R Supply Inc. (“A-Power,” “we,” “us” or “our”). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

1. Use of the Site

The Site is intended for HVAC contractors, refrigeration technicians, solar installers and other trade professionals seeking wholesale supply information. You agree to use the Site only for lawful purposes and in accordance with these Terms. You will not interfere with the Site, attempt to bypass security, scrape content for commercial republication, or use the Site to send unsolicited communications.

2. Wholesale Account & Eligibility

Pricing and certain features are reserved for verified contractor accounts. We may request business documentation, licensure, tax forms, or other proof of trade status before opening a wholesale account. We reserve the right to decline an application or close an account at our discretion.

3. Product Information

We work hard to keep product specifications, photos and descriptions accurate, but we do not warrant that all information on the Site is error-free, current, or complete. Manufacturer specs and rebate program rules can change without notice. Always confirm critical specifications, BTU ratings, refrigerant types, electrical requirements and warranty coverage with our team or the manufacturer before installation.

4. Orders, Pickup & Pricing

• Wholesale prices, promotions and availability are subject to change without notice.
• Orders are confirmed only when accepted by our team after stock and account verification.
• Same-day pickup at our Hicksville counter is offered for in-stock items, subject to volume and time of day.
• You are responsible for safe loading, transport and handling of products after pickup.

5. Returns & Warranty

Returns of wholesale equipment are subject to manufacturer policies and applicable restocking conditions. Items must be unused, undamaged, and returned with original packaging and documentation within the timeframe stated at the time of sale. Manufacturer warranties pass through to the buyer; A-Power facilitates warranty claims but does not assume manufacturer obligations.

6. Rebate Assistance

A-Power may help contractors gather documentation for HVAC, refrigeration or solar rebate programs. Rebate eligibility, amounts, deadlines and approval are determined solely by the relevant utility, government program or third-party administrator. We make no guarantee that any rebate will be approved or paid.

7. Intellectual Property

All Site content — including text, graphics, logos, images, audio, video and software — is owned by A-Power or its licensors and is protected by copyright, trademark and other laws. You may view and print pages for personal trade use, but you may not reproduce, modify, distribute, publicly display, or create derivative works without our prior written consent.

8. Third-Party Brands & Links

Manufacturer brand names and logos referenced on the Site are the property of their respective owners and are used only to identify products A-Power distributes. The Site may also link to third-party websites; we are not responsible for content, products or practices of those sites.

9. Disclaimers

The Site and our products are provided “as is” and “as available.” To the fullest extent permitted by law, A-Power disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Installation, sizing and code compliance are the responsibility of the licensed contractor performing the work.

10. Limitation of Liability

To the fullest extent permitted by law, A-Power and its affiliates, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, including lost profits, loss of business, or damage arising out of installation or use of products, whether based on contract, tort or any other legal theory. Our aggregate liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

11. Indemnification

You agree to indemnify and hold A-Power harmless from any claims, liabilities, damages, losses or expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your misuse of the Site, or your installation, sale or service of products purchased from us.

12. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute arising from these Terms or use of the Site shall be brought exclusively in the state or federal courts located in Nassau County, New York, and you consent to the personal jurisdiction of those courts.

13. Changes to These Terms

We may update these Terms from time to time by posting a revised version on this page. Material changes will be highlighted and the “Effective Date” updated. Your continued use of the Site after changes are posted constitutes acceptance.
